Terms of Service
QolSync AI is operated by CHONGS CLOUD CONSULTING SERVICE LLC ("C3S LLC", "we"), 16113 SE 170th Pl, Renton, WA 98058, United States. These Terms are an agreement between you and C3S LLC. For support, contact support@qolsync.ai.
1. Acceptance of Terms
By accessing or using QolSync AI, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not access or use the service.
2. Service Description
QolSync AI provides real-time, AI-powered translation, transcription and captioning across 100+ languages. It is offered as an app for iPhone and iPad, as an app for Zoom meetings and webinars, and on our website, including links that let an event audience listen in a web browser. Features and limits vary by plan and by where you bought it.
3. AI Translation Notice
QolSync AI uses artificial intelligence to transcribe, translate and summarize speech, text and documents. AI output can contain errors, omissions and mistranslations, and may be inaccurate, incomplete or misleading — particularly for names, numbers, dates, dosages, legal terms and idioms. QolSync AI is not a professional, sworn or certified translation service and is not a substitute for a qualified human interpreter or professional advisor. Do not rely on QolSync AI output as the sole basis for medical, legal, financial, immigration, safety or other significant decisions — verify important information with a qualified professional or with the original speaker. You are responsible for how you use the output.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use at security@qolsync.ai. You must be at least 13 years old — or older where the law of your country sets a higher minimum age or requires parental consent — to create or use a QolSync AI account. We do not permit anyone under 13 to create or use an account.
5. Billing and Payments
QolSync AI is free to download. New accounts start with a free 3-day trial, with no payment details needed; when the trial ends, purchased points keep two-way conversation, transcription and live translation available without a subscription, and a webinar broadcast needs one. You can buy a paid subscription or additional points in three ways: in the iOS app through the Apple App Store, billed to your Apple account; on our website, charged to the payment method you provide; or, for the Zoom app, a subscription through the Zoom App Marketplace. A subscription renews automatically until you cancel it. To stop a renewal, cancel an App Store subscription at least 24 hours before the end of the current period in your App Store account settings; manage a website subscription from your account on our website, and a Zoom App Marketplace subscription in Zoom. Cancellation takes effect at the end of the current billing period.
Points
Points are the prepaid unit you spend to use QolSync AI's translation, transcription, and document features. They are a service credit, not money: points have no cash value, cannot be redeemed for cash, cannot be transferred or resold, and are usable only inside QolSync AI. A paid plan grants points each month; you may also purchase additional points at any time.
Points included with a plan are granted per subscription at the start of each billing period, shared by all of its seats (a seat assigned through the Zoom App Marketplace receives its own grant), and expire at the end of that period. They do not carry over. An annual plan grants its points monthly, not all at once.
Points you purchase never expire and remain available while your account is open, including after a subscription ends. Purchased points are held for the account, and monthly plan points are always spent first. If you delete your account, unused points are forfeited; deleting an account does not by itself issue a refund.
Refunds follow the store you bought through. Purchases made in the iOS app are handled by Apple under Apple's terms and applicable law; Apple decides refunds and we cannot reverse that decision. Purchases made on our website are refunded by us, on request within 14 days, for points you have not used. If you are a consumer in the European Economic Area, the United Kingdom or Switzerland, you may also withdraw from a purchase on our website within 14 days of buying it; if you asked us to start providing the service during that period, we refund the price minus the value of what you used before you withdrew. Subscriptions bought through the Zoom App Marketplace are handled by Zoom under Zoom's terms. Monthly plan points are part of the plan and are not separately refundable. If a purchase is refunded, the points it granted are removed from your balance.
For live sessions using per-minute points billing, point usage and the displayed balance may update after a delay and may not reflect usage in real time. Time spent in a user-selected Pause remains billable while the session is kept available; confirmed interruptions to our service are not billed. We may deduct verified usage later, up to seven days after the end of each usage interval. For usage during a billing interruption, we deduct only from points held before the interruption that remain unused and unexpired when processed. We do not use points bought after the session ends for that earlier usage, create a negative point balance, or charge a payment method for any shortfall; we waive the shortfall. A delayed deduction does not trigger automatic top-up. If you have enabled automatic top-up, new or continuing usage may trigger it under the separate automatic top-up terms below. Your usage history shows delayed deductions and corrections with their amounts and processing dates. Points already refunded are not used for a delayed deduction. Existing refund rights remain unchanged.
If you turn on automatic top-up on the web, you authorise us to charge your saved payment method, without further notice and at unscheduled times, whenever your point balance falls below the threshold you set, for the point package you selected, up to the monthly limit you set. You can change or turn this off at any time in your account settings. We e-mail you when a top-up succeeds or fails.
An Event Pass is a one-time purchase for live events. An Event Pass bought in the iOS app does not require a subscription, includes a set amount of event time, can be used across sessions until that time is used up, and does not expire. An Event Pass bought on our website is available only with a plan that includes broadcasting or an active webinar subscription; it can be used across events until its time is used up, and expires 12 months after purchase. An unused Event Pass is forfeited if you delete your account; deleting an account does not by itself issue a refund.
6. Acceptable Use
You agree not to use QolSync AI for any unlawful purpose, to transmit harmful or offensive content, to attempt to reverse-engineer our technology, or to use the service in a way that degrades performance for other users. QolSync AI processes the speech of everyone it hears. Before you use it to capture other people's speech — for example in a meeting, a class or a conversation — you are responsible for telling them and for getting any consent that the law where you and they are located requires. In a Zoom meeting, QolSync AI joins as a visible participant so that everyone can see it is in use. You can stop using QolSync AI and delete your account at any time. We may suspend or close an account that breaks these Terms. Where practical, and unless the law, a security risk or abuse of the service prevents it, we will tell you why and give you a chance to respond.
7. Intellectual Property
You keep all rights to the content you provide or create with QolSync AI, such as audio, transcripts, translations and summaries. You give C3S LLC a limited, non-exclusive licence to host, process, transmit and display that content only to provide the service to you and to the people you choose to share it with, to keep the service secure and prevent abuse, and to comply with the law, as described in our Privacy Policy. We do not use your content to train AI models. C3S LLC keeps all rights to the app, the service and its underlying technology; third-party components and AI models belong to their owners.
8. Limitation of Liability
Except where mandatory consumer law provides otherwise (see "Your Statutory Rights" below), QolSync AI is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. AI output can contain errors — see the "AI Translation Notice" above — and service interruptions may occur despite reasonable efforts to maintain uptime. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential damages or for lost profits, and our aggregate liability shall not exceed the greater of the amount you paid us in the 12 months before the claim and USD 100.
9. Your Statutory Rights
Nothing in these Terms excludes, limits or restricts any right or remedy you have under applicable mandatory law that cannot be excluded, limited or restricted by agreement. If you are a consumer in the European Economic Area, the United Kingdom or Switzerland, this includes your statutory rights under local consumer-protection law and your legal guarantee that digital content and digital services conform to the contract. The limitations and exclusions in these Terms apply only to the maximum extent permitted by applicable law. We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for intentional misconduct or gross negligence.
10. Severability
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible, or if it cannot be enforced, treated as removed, and the remaining provisions will continue in full force and effect.
11. Governing Law & Consumer Forum
These Terms are governed by the laws of the State of Washington, United States, excluding its conflict-of-laws rules. If you are a consumer residing in the European Economic Area, the United Kingdom or Switzerland, you additionally benefit from any provisions of the law of your country of residence that are mandatory and cannot be derogated from by agreement, and nothing in this section deprives you of the protection of those provisions or of your right to bring proceedings in the courts of your place of residence.
12. Modifications
We may update these Terms. We will tell you about a material change by e-mail or in the app at least 30 days before it takes effect, unless a shorter time is needed to meet a legal requirement or to fix a security problem. A change does not apply to anything that happened before it takes effect. If you do not agree to a change, you can stop using the service and cancel your subscription before the change takes effect; if you keep using the service after that, the updated Terms apply.

Additional Terms for the Apple App Store
If you got QolSync AI from the Apple App Store, these Terms are between you and C3S LLC only, not Apple. You receive a non-transferable licence to use the app on Apple-branded products that you own or control, as the App Store's Usage Rules permit. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it; C3S LLC provides any maintenance and support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the app, and any other warranty that is not effectively disclaimed is the sole responsibility of C3S LLC. C3S LLC, not Apple, is responsible for handling any claims about the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer-protection claims and claims that the app infringes someone else's intellectual property. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties. You must follow any third-party terms that apply when you use the app, such as your mobile data agreement. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
